Welcome to FLUIS! The terms “we”, “us” and “our” refer to FLUIS. FLUIS operates this online store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). FLUIS is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when using the Services.

When you place an order, you are making an offer to purchase. FLUIS reserves the right to accept or reject your order at its sole discretion for any reason. Your order is not confirmed until FLUIS has accepted it.

Before accepting an order, we must receive and process payment. Please review your order carefully before submitting, as we may not be able to accommodate cancellation requests after acceptance. If we reject, modify or cancel an order, we will notify you using the email, billing address and/or phone number provided at checkout.

You represent and warrant that you are purchasing products for personal or household use only and not for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts and offers are subject to change without notice. The price charged for a product or service will be the price in effect at the time your order is placed and will be set out in your order confirmation email.

Unless otherwise stated, posted prices do not include taxes, customs duties, shipping, handling or import fees.

We are not responsible for delays in shipping or delivery. All delivery times are estimates only and are not guaranteed.

We are not liable for delays caused by carriers, customs procedures or events beyond our control. Once products are handed over to the carrier, title and risk of loss pass to you.

You may have access to tools or features provided by third parties as part of the Services, which we do not monitor, control or influence.

FLUIS is hosted and supported by Shopify, which enables us to provide the Services. However, sales and purchases made through our store are solely between you and FLUIS.

By using the Services, you understand and agree that Shopify is not responsible for any aspect of the transactions between you and FLUIS, including any injury, loss or damages arising from your purchase or use of our products or services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with FLUIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLUIS OR ITS PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS OR LICENSORS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, REPLACEMENT COSTS OR ANY SIMILAR DAMAGES, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We may assume control of the defense of any matter subject to indemnification at your expense. You agree to cooperate with us in such defense.

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. This will not affect the validity and enforceability of any other remaining provisions.

You may not assign, transfer or delegate these Terms or any of your rights or obligations without our prior written consent; any attempted assignment will be null and void.

We may assign, transfer or delegate these Terms and our rights and obligations without notice.

These Terms and any separate agreements under which we provide you the Services shall be governed and construed in accordance with the laws and courts of the jurisdiction in which FLUIS is established.

You and FLUIS agree to submit to the exclusive jurisdiction of such courts.
